陜西省人民政府辦公廳關于促進建筑業持續健康發展的實施意見

各(ge)設(she)區市人民(min)政府(fu),省人民(min)政府(fu)各(ge)工作部門、各(ge)直屬機構:

為貫徹落實《國(guo)(guo)務院辦公廳關于促(cu)進建筑(zhu)(zhu)業持續健康發(fa)展的意(yi)見》(國(guo)(guo)辦發(fa)〔2017〕19號),進一步深化建筑(zhu)(zhu)業“放管(guan)服”改革,加快產業轉型(xing)升級,促(cu)進全省建筑(zhu)(zhu)業持續健康發(fa)展,經省政(zheng)府同意(yi),現(xian)提出以(yi)下實施意(yi)見:

一、總體要(yao)求和(he)發展目(mu)標

牢固樹立創新、協調、綠(lv)色、開放、共享的發展(zhan)理念,圍繞提(ti)升工(gong)程質量(liang)安全(quan)水(shui)平和(he)增(zeng)(zeng)(zeng)強企業(ye)(ye)(ye)核心(xin)競爭力(li)(li),著力(li)(li)推(tui)進建(jian)筑業(ye)(ye)(ye)供給側結構性(xing)改(gai)革和(he)“放管(guan)服”改(gai)革,加(jia)大對(dui)龍頭企業(ye)(ye)(ye)的扶持力(li)(li)度,積(ji)極支(zhi)持民營企業(ye)(ye)(ye)發展(zhan),切實(shi)優化市(shi)場發展(zhan)環(huan)境(jing),努力(li)(li)實(shi)現(xian)(xian)全(quan)省(sheng)建(jian)筑業(ye)(ye)(ye)追趕超越、持續健康發展(zhan)。到2020年,全(quan)省(sheng)特級企業(ye)(ye)(ye)總數跨入全(quan)國(guo)前列,新增(zeng)(zeng)(zeng)一級資質企業(ye)(ye)(ye)150家,年產值(zhi)超過100億元的企業(ye)(ye)(ye)10家以(yi)(yi)上(shang)(shang);實(shi)現(xian)(xian)建(jian)筑業(ye)(ye)(ye)增(zeng)(zeng)(zeng)加(jia)值(zhi)占(zhan)GDP比重8.5%以(yi)(yi)上(shang)(shang),建(jian)筑業(ye)(ye)(ye)外向度達到40%左右(you);新增(zeng)(zeng)(zeng)省(sheng)級以(yi)(yi)上(shang)(shang)企業(ye)(ye)(ye)技術研發中心(xin)5個(ge),獲得國(guo)家級工(gong)法(fa)、專利50項以(yi)(yi)上(shang)(shang),新創魯班獎不低于25項,勞務用工(gong)制度改(gai)革和(he)裝配(pei)式(shi)建(jian)筑發展(zhan)取(qu)得明顯成(cheng)效。

二、深化建筑業簡(jian)政(zheng)放權改革

(一(yi))優化資(zi)(zi)質資(zi)(zi)格管(guan)理。下放(fang)部分省級行(xing)政審(shen)(shen)批(pi)權限,全面推行(xing)電子(zi)化審(shen)(shen)批(pi),試(shi)(shi)行(xing)建(jian)設工程企(qi)業(ye)(ye)和(he)個(ge)人(ren)(ren)電子(zi)資(zi)(zi)質資(zi)(zi)格證書,簡化企(qi)業(ye)(ye)資(zi)(zi)質審(shen)(shen)批(pi)流程,提(ti)高行(xing)政審(shen)(shen)批(pi)效率。適當(dang)放(fang)寬崗位證書、執(zhi)(zhi)業(ye)(ye)資(zi)(zi)格考試(shi)(shi)報名條件,精簡注冊認證環(huan)節(jie),縮短發證、認證時限。強化個(ge)人(ren)(ren)執(zhi)(zhi)業(ye)(ye)資(zi)(zi)格管(guan)理,建(jian)立(li)個(ge)人(ren)(ren)執(zhi)(zhi)業(ye)(ye)保險制度,有序發展個(ge)人(ren)(ren)執(zhi)(zhi)業(ye)(ye)事務所(suo),加(jia)大對執(zhi)(zhi)業(ye)(ye)人(ren)(ren)員責任(ren)追究(jiu)和(he)處罰力度,嚴厲(li)打擊資(zi)(zi)格掛靠行(xing)為。

(二)加快推進信(xin)(xin)用(yong)體系建(jian)(jian)設。整合完善(shan)全省統一的(de)建(jian)(jian)筑市(shi)場(chang)誠(cheng)(cheng)信(xin)(xin)監管(guan)平臺(tai),制定建(jian)(jian)筑行(xing)業(ye)誠(cheng)(cheng)信(xin)(xin)評價辦法(fa),實現企業(ye)和人員信(xin)(xin)息(xi)、工程建(jian)(jian)設信(xin)(xin)息(xi)、信(xin)(xin)用(yong)信(xin)(xin)息(xi)實時更新,并及時將相關信(xin)(xin)用(yong)信(xin)(xin)息(xi)匯(hui)集至省公共信(xin)(xin)用(yong)信(xin)(xin)息(xi)平臺(tai),實現建(jian)(jian)設、工商(shang)、稅務、人社、金融、司法(fa)等各類信(xin)(xin)息(xi)共享互認。推進市(shi)場(chang)主體信(xin)(xin)用(yong)信(xin)(xin)息(xi)在資質許可(ke)、招標投標等環節的(de)應(ying)用(yong),實施分類動(dong)態(tai)監管(guan)和差別化管(guan)理,健全誠(cheng)(cheng)信(xin)(xin)激勵和失信(xin)(xin)懲(cheng)戒機制,營造“守信(xin)(xin)處(chu)處(chu)受益、失信(xin)(xin)處(chu)處(chu)受限(xian)”的(de)市(shi)場(chang)環境。

(三(san))完善工(gong)程(cheng)招投(tou)標(biao)(biao)制(zhi)度(du)。以國有投(tou)資為主(zhu)(zhu)、依法必(bi)須招標(biao)(biao)的工(gong)程(cheng)建(jian)設(she)項目要全(quan)部納入全(quan)省統一(yi)的公共資源(yuan)交易(yi)平臺,全(quan)面推(tui)進交易(yi)全(quan)過程(cheng)電子化,推(tui)行網上(shang)異地(di)評標(biao)(biao)。對依法通過競爭性談判或單一(yi)來源(yuan)方式確定(ding)供應(ying)商的政府(fu)采購工(gong)程(cheng)建(jian)設(she)項目,符合相應(ying)條件的應(ying)當(dang)頒發(fa)施工(gong)許(xu)可證(zheng)。非(fei)政府(fu)投(tou)資工(gong)程(cheng)由建(jian)設(she)單位(wei)自主(zhu)(zhu)決定(ding)發(fa)包方式。完善工(gong)程(cheng)招標(biao)(biao)“限(xian)高保低(di)”管(guan)理辦法和中標(biao)(biao)備案制(zhi)度(du),整(zheng)合建(jian)立(li)全(quan)省統一(yi)的綜合評標(biao)(biao)專家(jia)庫(ku)。各地(di)要結合全(quan)省公共資源(yuan)交易(yi)平臺整(zheng)合,配齊配強(qiang)招投(tou)標(biao)(biao)監管(guan)隊伍,加強(qiang)招投(tou)標(biao)(biao)全(quan)過程(cheng)監管(guan)。

三(san)、改(gai)進工程(cheng)建造(zao)組(zu)織模式

(四(si))推(tui)進(jin)建(jian)(jian)筑(zhu)產業現(xian)代化(hua)。各地(di)要研究(jiu)制定推(tui)進(jin)智能和裝(zhuang)配(pei)式建(jian)(jian)筑(zhu)發(fa)展(zhan)(zhan)的(de)具體(ti)措施(shi),合理布(bu)局產業基地(di)建(jian)(jian)設(she),加強基礎和關鍵技術、建(jian)(jian)筑(zhu)信(xin)息模型(xing)技術(BIM)的(de)研究(jiu)運(yun)用,積極培育(yu)產業化(hua)龍(long)頭骨干企(qi)業,努力實(shi)現(xian)建(jian)(jian)造方式從傳統(tong)到(dao)現(xian)代的(de)跨越發(fa)展(zhan)(zhan)。省(sheng)級相關部門(men)要加強指(zhi)導,協(xie)調解(jie)決(jue)裝(zhuang)配(pei)式建(jian)(jian)筑(zhu)發(fa)展(zhan)(zhan)的(de)重大問題。將(jiang)裝(zhuang)配(pei)式建(jian)(jian)筑(zhu)項目(mu)列為企(qi)業誠信(xin)評價加分范圍,給(gei)予優(you)先(xian)承攬工程項目(mu)、創優(you)評獎等(deng)政策激勵。到(dao)2020年,重點(dian)推(tui)進(jin)地(di)區裝(zhuang)配(pei)式建(jian)(jian)筑(zhu)占新建(jian)(jian)建(jian)(jian)筑(zhu)的(de)比例(li)達到(dao)20%以(yi)上,2025年全省(sheng)達到(dao)30%以(yi)上。

(五)大力(li)推行工(gong)程(cheng)(cheng)(cheng)總(zong)承(cheng)(cheng)包(bao)。裝配(pei)式建筑和政府投資工(gong)程(cheng)(cheng)(cheng)原則(ze)上采用工(gong)程(cheng)(cheng)(cheng)總(zong)承(cheng)(cheng)包(bao),工(gong)程(cheng)(cheng)(cheng)總(zong)承(cheng)(cheng)包(bao)單(dan)位(wei)對質量安全、進(jin)度控制、成本管(guan)理(li)等負(fu)總(zong)責。除(chu)以暫估價形式包(bao)括在(zai)工(gong)程(cheng)(cheng)(cheng)總(zong)承(cheng)(cheng)包(bao)范圍內且依法必須進(jin)行招(zhao)標的(de)項目外,工(gong)程(cheng)(cheng)(cheng)總(zong)承(cheng)(cheng)包(bao)合同涵蓋的(de)全過程(cheng)(cheng)(cheng)各專業業務,可由總(zong)承(cheng)(cheng)包(bao)單(dan)位(wei)直(zhi)接發(fa)包(bao)。推進(jin)工(gong)程(cheng)(cheng)(cheng)總(zong)承(cheng)(cheng)包(bao)項目實行分別(bie)計(ji)價、分別(bie)核算、各計(ji)其稅(shui)的(de)稅(shui)收征管(guan)辦法。開展工(gong)程(cheng)(cheng)(cheng)總(zong)承(cheng)(cheng)包(bao)試(shi)點(dian),完善與(yu)工(gong)程(cheng)(cheng)(cheng)總(zong)承(cheng)(cheng)包(bao)相(xiang)適應的(de)配(pei)套管(guan)理(li)制度,培育工(gong)程(cheng)(cheng)(cheng)總(zong)承(cheng)(cheng)包(bao)骨干企業。

(六)培(pei)育(yu)全(quan)過(guo)(guo)程(cheng)(cheng)(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)詢(xun)。支持投資(zi)咨(zi)(zi)詢(xun)、勘察(cha)、設計、監理(li)(li)、招標代理(li)(li)、造(zao)價(jia)(jia)等企業(ye)(ye)聯合經營、并購(gou)重組(zu),積極培(pei)育(yu)一(yi)批全(quan)過(guo)(guo)程(cheng)(cheng)(cheng)(cheng)(cheng)工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)詢(xun)服(fu)務(wu)企業(ye)(ye)。鼓勵擁有(you)單項資(zi)質(zhi)的中(zhong)介服(fu)務(wu)機構積極注冊建(jian)筑師(shi)、勘察(cha)設計師(shi)、監理(li)(li)工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)師(shi)、造(zao)價(jia)(jia)工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)師(shi)等專業(ye)(ye)人員,開展(zhan)工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)全(quan)過(guo)(guo)程(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)詢(xun)服(fu)務(wu)。改革工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)詢(xun)服(fu)務(wu)委托(tuo)方式,政府投資(zi)工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)要帶頭(tou)推行全(quan)過(guo)(guo)程(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)詢(xun)服(fu)務(wu),引導非政府投資(zi)工(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)委托(tuo)全(quan)過(guo)(guo)程(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)詢(xun)服(fu)務(wu),鼓勵在(zai)民用建(jian)筑項目(mu)中(zhong)發揮建(jian)筑師(shi)的主導作用。

四(si)、加(jia)強工程質量(liang)安全管理

(七)強(qiang)(qiang)化質(zhi)(zhi)量(liang)(liang)(liang)(liang)責(ze)(ze)(ze)任(ren)(ren)(ren)落(luo)實(shi)。全面落(luo)實(shi)各方(fang)主體(ti)的(de)(de)(de)(de)工(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)(liang)(liang)責(ze)(ze)(ze)任(ren)(ren)(ren),強(qiang)(qiang)化建設單(dan)位的(de)(de)(de)(de)首要(yao)責(ze)(ze)(ze)任(ren)(ren)(ren)和(he)勘察、設計、施工(gong)單(dan)位的(de)(de)(de)(de)主體(ti)責(ze)(ze)(ze)任(ren)(ren)(ren),實(shi)行(xing)“五方(fang)責(ze)(ze)(ze)任(ren)(ren)(ren)主體(ti)”項目負責(ze)(ze)(ze)人(ren)工(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)(liang)(liang)終身責(ze)(ze)(ze)任(ren)(ren)(ren)追(zhui)究。嚴(yan)格(ge)執行(xing)《建筑安裝工(gong)程(cheng)(cheng)工(gong)期(qi)(qi)定額》,夯(hang)實(shi)監理、監測、施工(gong)圖審查等單(dan)位的(de)(de)(de)(de)工(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)(liang)(liang)責(ze)(ze)(ze)任(ren)(ren)(ren),整(zheng)治規范(fan)建安工(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)(liang)(liang)檢(jian)測市場(chang),規范(fan)質(zhi)(zhi)量(liang)(liang)(liang)(liang)檢(jian)測機構行(xing)為。探(tan)索建立工(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)(liang)(liang)擔保(bao)保(bao)險制度和(he)建設單(dan)位對工(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)(liang)(liang)問題的(de)(de)(de)(de)先行(xing)處置和(he)賠(pei)償制度,充分發揮市場(chang)機制對工(gong)程(cheng)(cheng)質(zhi)(zhi)量(liang)(liang)(liang)(liang)的(de)(de)(de)(de)激勵(li)約束(shu)作用。嚴(yan)格(ge)執行(xing)工(gong)程(cheng)(cheng)竣(jun)工(gong)驗(yan)收標準(zhun),堅決糾(jiu)正竣(jun)工(gong)驗(yan)收把關(guan)不嚴(yan)、不按行(xing)業(ye)規范(fan)驗(yan)收等突出問題,未經竣(jun)工(gong)驗(yan)收合格(ge)的(de)(de)(de)(de)工(gong)程(cheng)(cheng)不得交付使(shi)用。房(fang)地產(chan)開發企業(ye)要(yao)依法(fa)合規經營,嚴(yan)格(ge)落(luo)實(shi)分戶(hu)驗(yan)收制度和(he)工(gong)程(cheng)(cheng)保(bao)修(xiu)期(qi)(qi)內的(de)(de)(de)(de)質(zhi)(zhi)量(liang)(liang)(liang)(liang)保(bao)修(xiu)責(ze)(ze)(ze)任(ren)(ren)(ren)。

(八)推進質量管(guan)理(li)標(biao)(biao)(biao)(biao)(biao)準(zhun)化(hua)。增加(jia)政府對標(biao)(biao)(biao)(biao)(biao)準(zhun)編(bian)制的(de)投入,加(jia)快(kuai)編(bian)制適合陜西歷(li)史(shi)文化(hua)、時代風(feng)貌的(de)設(she)計標(biao)(biao)(biao)(biao)(biao)準(zhun),積極培(pei)育團體(ti)標(biao)(biao)(biao)(biao)(biao)準(zhun)和企業標(biao)(biao)(biao)(biao)(biao)準(zhun),建(jian)(jian)立建(jian)(jian)筑標(biao)(biao)(biao)(biao)(biao)準(zhun)信息共(gong)享(xiang)機制,形成強制性(xing)標(biao)(biao)(biao)(biao)(biao)準(zhun)與(yu)其(qi)他(ta)標(biao)(biao)(biao)(biao)(biao)準(zhun)相(xiang)結(jie)合的(de)標(biao)(biao)(biao)(biao)(biao)準(zhun)體(ti)系(xi)。健全(quan)全(quan)省建(jian)(jian)設(she)標(biao)(biao)(biao)(biao)(biao)準(zhun)專家委員會(hui),為工程建(jian)(jian)設(she)標(biao)(biao)(biao)(biao)(biao)準(zhun)化(hua)工作提供技術支撐,提高標(biao)(biao)(biao)(biao)(biao)準(zhun)編(bian)制的(de)質量和水平(ping)。以創建(jian)(jian)文明工地(di)為抓手(shou),開展(zhan)標(biao)(biao)(biao)(biao)(biao)準(zhun)化(hua)示范活動。

(九)加(jia)強(qiang)安(an)全(quan)(quan)(quan)生產(chan)管理。全(quan)(quan)(quan)面(mian)落實建(jian)(jian)設工(gong)程參建(jian)(jian)各(ge)方主體(ti)的安(an)全(quan)(quan)(quan)責任,創新建(jian)(jian)筑(zhu)施工(gong)安(an)全(quan)(quan)(quan)監管模式(shi),以建(jian)(jian)筑(zhu)起重(zhong)機械、深基坑、高(gao)支模等為(wei)重(zhong)點,深入推(tui)(tui)進(jin)“六(liu)位一體(ti)”的施工(gong)安(an)全(quan)(quan)(quan)監管信息系統(tong)建(jian)(jian)設。推(tui)(tui)行塔吊、施工(gong)電梯(ti)等大(da)型設備(bei)和安(an)全(quan)(quan)(quan)執業(ye)人員聯網監管,建(jian)(jian)立全(quan)(quan)(quan)覆蓋、多層次、經常(chang)性的安(an)全(quan)(quan)(quan)生產(chan)培訓制度(du),完善建(jian)(jian)筑(zhu)施工(gong)安(an)全(quan)(quan)(quan)監督層級(ji)考核制度(du)。健全(quan)(quan)(quan)質量(liang)安(an)全(quan)(quan)(quan)“黑名單”制度(du),強(qiang)化質量(liang)安(an)全(quan)(quan)(quan)信用(yong)懲戒。

(十)提升監(jian)(jian)(jian)管(guan)水平。全面落實(shi)工(gong)程項(xiang)目(mu)關鍵(jian)(jian)崗位人員實(shi)名制(zhi)管(guan)理,強化政(zheng)府對涉及公(gong)共安(an)全的(de)(de)工(gong)程地基基礎、主(zhu)體結構(gou)關鍵(jian)(jian)部(bu)位和工(gong)程竣工(gong)等環節的(de)(de)監(jian)(jian)(jian)督檢(jian)查,完(wan)善監(jian)(jian)(jian)理單位向監(jian)(jian)(jian)督機(ji)(ji)構(gou)定(ding)期(qi)報告工(gong)程質(zhi)量情況的(de)(de)制(zhi)度,落實(shi)相關職能(neng)(neng)部(bu)門的(de)(de)監(jian)(jian)(jian)管(guan)責任。各地要加強工(gong)程質(zhi)量安(an)全監(jian)(jian)(jian)督隊(dui)伍建(jian)設(she),監(jian)(jian)(jian)督機(ji)(ji)構(gou)履(lv)行職能(neng)(neng)所需(xu)經費由(you)同(tong)級財(cai)政(zheng)預算(suan)全額保障。監(jian)(jian)(jian)管(guan)力量不足的(de)(de),可采取政(zheng)府購(gou)買服務的(de)(de)方式,委(wei)托具備條件的(de)(de)社會力量進行工(gong)程質(zhi)量安(an)全監(jian)(jian)(jian)督檢(jian)查。

五、優(you)化建(jian)筑(zhu)市場環境

(十一)建(jian)(jian)立開放(fang)有序的市(shi)(shi)場。嚴(yan)格(ge)落實推動(dong)建(jian)(jian)筑市(shi)(shi)場統一開放(fang)的有關規定,對省(sheng)建(jian)(jian)筑市(shi)(shi)場誠(cheng)信監(jian)(jian)管平臺可查詢的省(sheng)內外建(jian)(jian)筑業企業,各(ge)市(shi)(shi)(區)、縣不得變(bian)相(xiang)設立審批、備(bei)案等(deng)準入條件。各(ge)級住房城鄉(xiang)建(jian)(jian)設、交(jiao)通運輸(shu)、水利等(deng)職能部門要(yao)結合日常業務辦理(li)和(he)市(shi)(shi)場監(jian)(jian)管,及時采集各(ge)類信息,加大資質(zhi)動(dong)態(tai)考核和(he)現場檢查的力度,嚴(yan)厲打擊圍標串標、肢解發包、轉包、非法分包、資質(zhi)資格(ge)掛靠等(deng)違(wei)法違(wei)規行為,強(qiang)化市(shi)(shi)場清(qing)出管理(li)。

(十(shi)二)全面推行(xing)雙向(xiang)(xiang)擔(dan)保(bao)(bao)(bao)(bao)制度(du)(du)。嚴格執行(xing)以銀(yin)行(xing)保(bao)(bao)(bao)(bao)函(han)(han)或(huo)擔(dan)保(bao)(bao)(bao)(bao)公司保(bao)(bao)(bao)(bao)函(han)(han)等形式的(de)擔(dan)保(bao)(bao)(bao)(bao)制度(du)(du),工程建(jian)(jian)設開工前,建(jian)(jian)設單(dan)位(wei)和承包(bao)單(dan)位(wei)要向(xiang)(xiang)對(dui)方提供工程款(kuan)支付(fu)擔(dan)保(bao)(bao)(bao)(bao)和履約擔(dan)保(bao)(bao)(bao)(bao),未提供工程款(kuan)支付(fu)擔(dan)保(bao)(bao)(bao)(bao)的(de)建(jian)(jian)設單(dan)位(wei)不予辦理施工許可(ke)證,無法提供履約擔(dan)保(bao)(bao)(bao)(bao)的(de)承包(bao)單(dan)位(wei)不得參與投(tou)標。對(dui)采用通用技(ji)術和性能(neng)標準的(de)政府(fu)投(tou)資工程項目,原(yuan)則上采用固(gu)定(ding)總價(jia)(jia)合同的(de)“限(xian)高(gao)保(bao)(bao)(bao)(bao)低”辦法,承包(bao)單(dan)位(wei)要按(an)照(zhao)招(zhao)標最高(gao)限(xian)價(jia)(jia)提供履約擔(dan)保(bao)(bao)(bao)(bao),防止惡意低價(jia)(jia)中標。

(十三(san))從嚴規范工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)價(jia)款(kuan)結(jie)算。完善工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)量清單(dan)計(ji)(ji)(ji)價(jia)體系和(he)工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)造(zao)價(jia)信息發布機制(zhi),形(xing)成(cheng)統一的(de)(de)工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)造(zao)價(jia)計(ji)(ji)(ji)價(jia)規則(ze),合理(li)確定和(he)有(you)(you)效控制(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)造(zao)價(jia)。審(shen)計(ji)(ji)(ji)部門(men)應(ying)當依法加強對以政府投資為主的(de)(de)公(gong)共建設(she)項(xiang)目的(de)(de)審(shen)計(ji)(ji)(ji)督導,建設(she)單(dan)位(wei)不得(de)(de)以未完成(cheng)審(shen)計(ji)(ji)(ji)作為延期工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)結(jie)算、拖(tuo)欠工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)款(kuan)的(de)(de)理(li)由。未完成(cheng)竣工(gong)(gong)(gong)(gong)(gong)(gong)結(jie)算的(de)(de)項(xiang)目,不得(de)(de)辦理(li)產權登記。對有(you)(you)拖(tuo)欠工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)款(kuan)的(de)(de)單(dan)位(wei)不得(de)(de)批(pi)準新項(xiang)目開(kai)(kai)工(gong)(gong)(gong)(gong)(gong)(gong)。嚴格(ge)執行預付(fu)款(kuan)制(zhi)度,建設(she)單(dan)位(wei)在合同簽(qian)訂后、正式開(kai)(kai)工(gong)(gong)(gong)(gong)(gong)(gong)前,應(ying)當向(xiang)承包單(dan)位(wei)支付(fu)不低于合同總額 10%的(de)(de)預付(fu)款(kuan),重大工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)項(xiang)目要根(gen)據工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)進度按期預付(fu)。

(十四)下大力減輕企業(ye)負擔。嚴(yan)格(ge)執行(xing)中省有關建設工(gong)(gong)程(cheng)領域保(bao)證(zheng)(zheng)金(jin)的規(gui)定要求,不得擅(shan)自設立(li)法定之外的其他(ta)保(bao)證(zheng)(zheng)金(jin),任何單位不得拒收建筑業(ye)企業(ye)提供(gong)的銀(yin)行(xing)保(bao)函或(huo)擔保(bao)公司保(bao)函。工(gong)(gong)程(cheng)項目竣工(gong)(gong)前,已(yi)繳納履約保(bao)證(zheng)(zheng)金(jin)或(huo)采用工(gong)(gong)程(cheng)質(zhi)量(liang)擔保(bao)、保(bao)險等其他(ta)保(bao)證(zheng)(zheng)方(fang)式的,發(fa)(fa)包人(ren)不得再預留工(gong)(gong)程(cheng)質(zhi)量(liang)保(bao)證(zheng)(zheng)金(jin)。嚴(yan)格(ge)規(gui)范各類涉企收費,大力推進(jin)政府投(tou)資工(gong)(gong)程(cheng)欠款的清理(li)償還工(gong)(gong)作,堅決制止發(fa)(fa)生新的拖欠,切實保(bao)護(hu)承包企業(ye)根本利(li)益(yi)。

六、提高從業(ye)人員素質

(十五)加大(da)(da)建筑(zhu)(zhu)人(ren)(ren)才(cai)培(pei)(pei)(pei)養(yang)力(li)(li)度(du)。發揮政(zheng)府主導作(zuo)用,通過政(zheng)策(ce)優惠、財政(zheng)補(bu)貼等方式,加強建筑(zhu)(zhu)行(xing)業(ye)(ye)高(gao)端人(ren)(ren)才(cai)、產(chan)業(ye)(ye)化人(ren)(ren)才(cai)和復合型人(ren)(ren)才(cai)的(de)培(pei)(pei)(pei)養(yang)與引(yin)進。做好(hao)建筑(zhu)(zhu)工(gong)人(ren)(ren)崗前培(pei)(pei)(pei)訓工(gong)作(zuo),特級企業(ye)(ye)、具備條件的(de)一(yi)級總承包(bao)企業(ye)(ye)和社會機構(gou)可組(zu)織(zhi)開展建筑(zhu)(zhu)工(gong)人(ren)(ren)職(zhi)業(ye)(ye)技(ji)能培(pei)(pei)(pei)訓與鑒定(ding)。完善(shan)注冊執(zhi)業(ye)(ye)人(ren)(ren)員資格考試(shi)辦法(fa),突(tu)出實踐能力(li)(li)和專(zhuan)業(ye)(ye)知識考核,對(dui)長期從(cong)事(shi)工(gong)程技(ji)術、管(guan)理的(de)人(ren)(ren)員減免考試(shi)科目。大(da)(da)力(li)(li)弘揚工(gong)匠(jiang)精神,探索建立獲得重大(da)(da)表彰項目負責人(ren)(ren)破(po)格參評專(zhuan)業(ye)(ye)技(ji)術職(zhi)稱制度(du),組(zu)織(zhi)開展建筑(zhu)(zhu)工(gong)匠(jiang)技(ji)能大(da)(da)賽,評選 “三秦魯(lu)班大(da)(da)師”。

(十(shi)六)推(tui)進(jin)勞(lao)務用(yong)(yong)工(gong)(gong)制(zhi)度改(gai)革(ge)(ge)。改(gai)革(ge)(ge)建(jian)(jian)筑(zhu)用(yong)(yong)工(gong)(gong)方式,在省(sheng)內取消勞(lao)務資質,建(jian)(jian)立以施(shi)工(gong)(gong)總承包(bao)企業(ye)(ye)(ye)(ye)自有(you)(you)工(gong)(gong)人為(wei)(wei)骨干、專業(ye)(ye)(ye)(ye)承包(bao)和專業(ye)(ye)(ye)(ye)作(zuo)業(ye)(ye)(ye)(ye)企業(ye)(ye)(ye)(ye)自有(you)(you)工(gong)(gong)人為(wei)(wei)主(zhu)體(ti)、勞(lao)務派遣為(wei)(wei)補(bu)充的(de)多元化用(yong)(yong)工(gong)(gong)方式。鼓勵施(shi)工(gong)(gong)企業(ye)(ye)(ye)(ye)將部分(fen)技能水平高的(de)農民(min)工(gong)(gong)轉化為(wei)(wei)自有(you)(you)工(gong)(gong)人,引導有(you)(you)一(yi)定管理能力的(de)班(ban)組長組建(jian)(jian)小微專業(ye)(ye)(ye)(ye)作(zuo)業(ye)(ye)(ye)(ye)企業(ye)(ye)(ye)(ye),享(xiang)受(shou)政府稅收減免政策,穩(wen)定和擴大農民(min)工(gong)(gong)在建(jian)(jian)筑(zhu)行業(ye)(ye)(ye)(ye)就業(ye)(ye)(ye)(ye)創業(ye)(ye)(ye)(ye)。推(tui)行企業(ye)(ye)(ye)(ye)用(yong)(yong)工(gong)(gong)實(shi)名制(zhi)管理,加快推(tui)進(jin)建(jian)(jian)筑(zhu)用(yong)(yong)工(gong)(gong)信息(xi)(xi)(xi)管理平臺建(jian)(jian)設,實(shi)現建(jian)(jian)筑(zhu)工(gong)(gong)人身份信息(xi)(xi)(xi)、培訓情況、職業(ye)(ye)(ye)(ye)技能、從(cong)業(ye)(ye)(ye)(ye)記錄(lu)、工(gong)(gong)資支(zhi)付、誠信記錄(lu)及用(yong)(yong)工(gong)(gong)信息(xi)(xi)(xi)等互聯(lian)共享(xiang)。

(十七)切實維護工(gong)(gong)(gong)(gong)(gong)人合法權益。全面(mian)實施勞動合同(tong)制(zhi)度(du),用工(gong)(gong)(gong)(gong)(gong)單位要(yao)與(yu)建(jian)(jian)筑工(gong)(gong)(gong)(gong)(gong)人特(te)別是農(nong)民工(gong)(gong)(gong)(gong)(gong)依法簽(qian)訂勞動合同(tong)。用工(gong)(gong)(gong)(gong)(gong)單位要(yao)將(jiang)返還的勞保(bao)統籌(chou)費專(zhuan)項用于建(jian)(jian)筑工(gong)(gong)(gong)(gong)(gong)人社保(bao)繳納(na),企(qi)業或個人繳納(na)的建(jian)(jian)筑工(gong)(gong)(gong)(gong)(gong)人城(cheng)鎮職(zhi)工(gong)(gong)(gong)(gong)(gong)社保(bao)和城(cheng)鄉居(ju)民社保(bao),在(zai)資(zi)(zi)質(zhi)許可(ke)中予(yu)(yu)以認可(ke)。實行(xing)建(jian)(jian)筑工(gong)(gong)(gong)(gong)(gong)人工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)月清月結(jie)制(zhi)度(du),按照“誰用工(gong)(gong)(gong)(gong)(gong)、誰負責(ze)”和“總(zong)承包負總(zong)責(ze)”的原則落(luo)實工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)支(zhi)付(fu)和監督責(ze)任(ren),為(wei)建(jian)(jian)筑工(gong)(gong)(gong)(gong)(gong)人工(gong)(gong)(gong)(gong)(gong)作、生活提供可(ke)靠保(bao)障。將(jiang)有拖欠工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)行(xing)為(wei)的企(qi)業和法人列入(ru)黑名單,給予(yu)(yu)限(xian)制(zhi)市場(chang)準入(ru)等(deng)懲戒(jie)措施。

七、增強企業核心競爭力

(十八)大力(li)(li)扶(fu)(fu)持培(pei)育龍頭(tou)企(qi)業(ye)(ye)。加大對(dui)龍頭(tou)骨(gu)干(gan)企(qi)業(ye)(ye)的扶(fu)(fu)持力(li)(li)度,鼓(gu)勵企(qi)業(ye)(ye)之間兼并重(zhong)組(zu),培(pei)育指(zhi)導(dao)龍頭(tou)企(qi)業(ye)(ye)上(shang)市,大型骨(gu)干(gan)企(qi)業(ye)(ye)升級(ji)、增(zeng)項(xiang)和(he)分立、成立子(zi)公司時(shi)在(zai)資質等方(fang)面(mian)予以(yi)重(zhong)點(dian)扶(fu)(fu)持。對(dui)建筑業(ye)(ye)企(qi)業(ye)(ye)入庫產(chan)值較上(shang)年增(zeng)幅超過本地(di)當(dang)年GDP增(zeng)速(su)的,應(ying)當(dang)全面(mian)落(luo)實各項(xiang)稅收(shou)優(you)惠(hui)政策,支持企(qi)業(ye)(ye)發(fa)展。相(xiang)關部門要(yao)對(dui)重(zhong)點(dian)扶(fu)(fu)持企(qi)業(ye)(ye)在(zai)建立技術中(zhong)心、申請工法、專利及國家、省級(ji)獎(jiang)項(xiang)等方(fang)面(mian)優(you)先受理和(he)推薦,支持企(qi)業(ye)(ye)增(zeng)強(qiang)科技創(chuang)新能力(li)(li),提升自(zi)主品牌效應(ying)。對(dui)獲得(de)國家、省市優(you)質工程和(he)標準(zhun)化管理示范工地(di)、晉升特級(ji)和(he)一(yi)級(ji)總承(cheng)包資質的,各地(di)要(yao)制定相(xiang)應(ying)獎(jiang)勵辦法,激發(fa)企(qi)業(ye)(ye)爭先創(chuang)優(you)的積極性。

(十九)積極(ji)支持(chi)民(min)(min)營(ying)(ying)(ying)(ying)企(qi)業(ye)(ye)發展。出(chu)臺(tai)支持(chi)貧困縣建(jian)筑(zhu)業(ye)(ye)發展扶(fu)持(chi)政策(ce),引(yin)導大(da)型龍(long)頭企(qi)業(ye)(ye)與(yu)貧困縣民(min)(min)營(ying)(ying)(ying)(ying)建(jian)筑(zhu)企(qi)業(ye)(ye)開展一對(dui)一幫扶(fu),“以(yi)大(da)帶(dai)小(xiao)”共同(tong)發展,吸引(yin)當地(di)農民(min)(min)工就(jiu)業(ye)(ye)。有(you)序推(tui)進國有(you)和集體(ti)建(jian)筑(zhu)企(qi)業(ye)(ye)混合(he)所有(you)制改(gai)革,原企(qi)業(ye)(ye)在職職工自愿離職的(de),通過建(jian)筑(zhu)行(xing)業(ye)(ye)勞保統籌費用(yong)一次性(xing)補償(chang)解決職工社保問題。信用(yong)好、實(shi)力強的(de)優勢民(min)(min)營(ying)(ying)(ying)(ying)企(qi)業(ye)(ye)享受與(yu)龍(long)頭骨干企(qi)業(ye)(ye)的(de)同(tong)等(deng)扶(fu)持(chi)政策(ce)。財(cai)政、住房城鄉建(jian)設、金融等(deng)部門要創(chuang)新投融資(zi)方式(shi),積極(ji)搭(da)建(jian)優勢民(min)(min)營(ying)(ying)(ying)(ying)企(qi)業(ye)(ye)與(yu)金融機構、龍(long)頭企(qi)業(ye)(ye)合(he)作(zuo)的(de)平臺(tai),切實(shi)幫助民(min)(min)營(ying)(ying)(ying)(ying)企(qi)業(ye)(ye)破(po)解投融資(zi)渠道不暢、拓展市場能力不足的(de)問題。

(二十)支持(chi)(chi)發(fa)展建(jian)(jian)筑(zhu)業總部(bu)經(jing)濟(ji)。各地要制定引導(dao)扶(fu)持(chi)(chi)政策,吸引央(yang)(yang)企(qi)、省內外大型優(you)勢企(qi)業在(zai)行政區域(yu)內設(she)立(li)總部(bu)或成立(li)子(zi)公司,優(you)先保(bao)障(zhang)企(qi)業落(luo)戶(hu)所需的(de)(de)生產(chan)生活用(yong)地。央(yang)(yang)企(qi)或外省大型骨干(gan)企(qi)業在(zai)陜落(luo)戶(hu)的(de)(de),參照我省優(you)勢企(qi)業給予重點扶(fu)持(chi)(chi)。有條件的(de)(de)地方可建(jian)(jian)立(li)具有區域(yu)特色的(de)(de)建(jian)(jian)筑(zhu)產(chan)業園區,整合裝備制造、建(jian)(jian)材生產(chan)、設(she)計咨詢(xun)、資金物流等要素,引導(dao)建(jian)(jian)筑(zhu)業企(qi)業集聚(ju)發(fa)展,努(nu)力(li)形(xing)成當(dang)地經(jing)濟(ji)新的(de)(de)增(zeng)長極。

(二十一)鼓勵企(qi)(qi)(qi)(qi)業“走出(chu)去”發(fa)展(zhan)。結合國家“一帶一路”戰略規(gui)劃(hua)和區域發(fa)展(zhan)規(gui)劃(hua),加(jia)大(da)對我省建(jian)筑(zhu)企(qi)(qi)(qi)(qi)業拓展(zhan)境外(wai)(wai)市場(chang)的(de)支持力(li)度(du),給(gei)予企(qi)(qi)(qi)(qi)業承(cheng)(cheng)接境外(wai)(wai)工(gong)程項目前期費用(yong)補助(zhu)、貸(dai)款貼息(xi)、對外(wai)(wai)投(tou)資合作(zuo)(zuo)保(bao)險(xian)費補助(zhu)、境外(wai)(wai)安全(quan)保(bao)障費用(yong)補助(zhu)、保(bao)函(han)費用(yong)等(deng)方面(mian)的(de)扶持。金融機(ji)構要積極支持我省企(qi)(qi)(qi)(qi)業對外(wai)(wai)承(cheng)(cheng)包業務(wu),加(jia)大(da)建(jian)筑(zhu)企(qi)(qi)(qi)(qi)業境外(wai)(wai)承(cheng)(cheng)接工(gong)程業務(wu)政策(ce)性(xing)信用(yong)保(bao)險(xian)的(de)支持力(li)度(du),降低企(qi)(qi)(qi)(qi)業收匯和融資風險(xian)。通過(guo)(guo)舉辦銀(yin)企(qi)(qi)(qi)(qi)合作(zuo)(zuo)對接會(hui)、對外(wai)(wai)企(qi)(qi)(qi)(qi)業推介會(hui)等(deng)形式,加(jia)大(da)統籌推進力(li)度(du),跟蹤(zong)解決企(qi)(qi)(qi)(qi)業在省境外(wai)(wai)承(cheng)(cheng)包工(gong)程過(guo)(guo)程中遇到的(de)困難,營造良好的(de)外(wai)(wai)部市場(chang)環境。

全(quan)省各(ge)級政府要高度重(zhong)(zhong)視建(jian)筑(zhu)(zhu)業(ye)(ye)(ye)“放管(guan)服”改(gai)(gai)革工(gong)(gong)(gong)作(zuo),充分認(ren)清加(jia)(jia)快建(jian)筑(zhu)(zhu)業(ye)(ye)(ye)改(gai)(gai)革發(fa)(fa)展(zhan)對于吸納和轉移農村(cun)富余勞(lao)動(dong)力(li)(li)、拉動(dong)相關產業(ye)(ye)(ye)發(fa)(fa)展(zhan)、推(tui)(tui)動(dong)新型城(cheng)鎮化進(jin)程、促(cu)進(jin)經濟(ji)平穩較快增(zeng)長的(de)重(zhong)(zhong)要意義(yi),進(jin)一步增(zeng)強責任感和緊(jin)迫感。省級相關部門要加(jia)(jia)大(da)指(zhi)導(dao)、協調和支(zhi)持(chi)力(li)(li)度,積極破解(jie)制約建(jian)筑(zhu)(zhu)業(ye)(ye)(ye)改(gai)(gai)革發(fa)(fa)展(zhan)的(de)“瓶頸”問題。各(ge)市(shi)、縣(xian)政府要切實(shi)把推(tui)(tui)進(jin)建(jian)筑(zhu)(zhu)業(ye)(ye)(ye)改(gai)(gai)革發(fa)(fa)展(zhan)工(gong)(gong)(gong)作(zuo)擺(bai)上(shang)重(zhong)(zhong)要議事日(ri)程,緊(jin)抓當前(qian)擴大(da)內需(xu)機遇,采取有力(li)(li)的(de)措施積極推(tui)(tui)進(jin),加(jia)(jia)大(da)政策扶(fu)持(chi)力(li)(li)度,不(bu)斷(duan)推(tui)(tui)進(jin)建(jian)筑(zhu)(zhu)業(ye)(ye)(ye)持(chi)續健康發(fa)(fa)展(zhan)。相關行(xing)(xing)業(ye)(ye)(ye)協會要及時反映企業(ye)(ye)(ye)訴求,反饋(kui)政策落實(shi)情況,發(fa)(fa)揮好規(gui)范行(xing)(xing)業(ye)(ye)(ye)秩序、建(jian)立從業(ye)(ye)(ye)人員行(xing)(xing)業(ye)(ye)(ye)準則、促(cu)進(jin)企業(ye)(ye)(ye)誠(cheng)信經營等方面的(de)自律作(zuo)用。本實(shi)施意見(jian)下發(fa)(fa)之日(ri)起30個工(gong)(gong)(gong)作(zuo)日(ri)內,各(ge)市(shi)(區(qu))、省直(zhi)管(guan)縣(xian)要將推(tui)(tui)進(jin)建(jian)筑(zhu)(zhu)業(ye)(ye)(ye)改(gai)(gai)革發(fa)(fa)展(zhan)的(de)具(ju)體措施書面報省政府辦公廳,并(bing)抄(chao)送省住房(fang)城(cheng)鄉建(jian)設(she)廳。
